Notary Public Fees

A New York notary public may charge the following fees:

  • Acknowledgments – $2 per person.
  • Oaths and Affirmations – $2 per person.
  • Protests – 75 cents. For each notice of protest, not exceeding five notices on any bill or note, the fee is 10 cents.
  • Proofs of Execution by Subscribing Witnesses – $2 for each absent principal, plus $2 for swearing in the subscribing witness.
  • Electronic Notarial Acts – $25.

Notaries are not required to charge for performing a notarial act.

Charging more than the fees above may subject the notary public to be removed from office, criminal prosecution, and civil action.

A notary may not charge an additional fee for affixing a seal on a certificate of protest or any other notarial certificate.

No fee may be charged by a notary public who is on the staff of a county clerk and who has been designated by law to notarize for the public during normal business hours.

No fee may be charged by a notary public for administering the oath of office to a member of the legislature, to any military personnel, to an inspector of elections or clerk of the poll or to any other public officer or public employee.

A New York notary may not divide or agree to divide their fees with an attorney.

A New York notary may not accept any part of an attorney’s fee for any legal business.
